Passing score
A scaled score of 70 on each portion, general and Delaware law, with both portions passed. Raw scores are converted into scaled scores that range from 0 to 100 and are equated across exam forms, so 70 is not a raw percentage. Numeric scores are reported only to failing candidates.
How it is taken
In person at Pearson VUE test centers. Walk-in examinations are not available and candidates must reserve online or by phone at least 24 hours before the desired date. Report to the test center at least 30 minutes before the appointment.
If you fail
A candidate may sit each portion (general and Delaware law) in no more than three attempts, and must pass both within one year of completing the 99-hour pre-licensing course; otherwise the pre-licensing course must be retaken. Reexamination reservations cannot be made at a test center and require a 24-hour wait before rescheduling. Every attempt costs the full $88 exam fee. Free Delaware practice questions

10 questions written for the Delaware exam, drawn from 12 in the ApexAgent bank. The correct answer and the reasoning are under each one.

  1. 1. How many members serve on the Delaware Real Estate Commission?

    • A. Five
    • B. Seven
    • C. Nine ✓
    • D. Eleven

Why: Section 2903(b) of Title 24 of the Delaware Code creates a nine-member Delaware Real Estate Commission appointed by the Governor: five professional members (three licensed brokers, one associate broker, and one salesperson) and four public members. One public member must come from each county and one from the City of Wilmington.

  2. 2. The minimum age to hold a Delaware real estate salesperson license is:

    • A. 16
    • B. 18 ✓
    • C. 21
    • D. 23

Why: Section 2907(b)(2) of Title 24 of the Delaware Code requires a salesperson applicant to be at least 18 years of age. A higher age applies to the broker-level licenses: an associate broker applicant must be at least 23 under Section 2907(c)(2).

  3. 3. What is the minimum age for a Delaware associate broker license?

    • A. 18
    • B. 21
    • C. 23 ✓
    • D. 25

Why: Section 2907(c)(2) of Title 24 of the Delaware Code requires an associate broker applicant to be at least 23 years of age, in addition to meeting the experience and financial requirements set by the Commission's rules. The minimum age for the entry salesperson license is lower, at 18.

  4. 4. A Delaware salesperson pre-licensing course must include how many hours of instruction?

    • A. 63
    • B. 75
    • C. 90
    • D. 99 ✓

Why: The Delaware Real Estate Commission requires a 99-hour salesperson pre-licensing course. The Commission's Education Guidelines in 24 Delaware Administrative Code 2925 divide the 99 hours into Real Estate Sales (36 hours), Real Estate Law (33 hours), and Real Estate Mathematics (24 hours) with orientation and a final review, and permit the entire course to be taken through distance education.

  5. 5. How many scored items does the Delaware law (state) portion of the salesperson examination contain?

    • A. 30
    • B. 40 ✓
    • C. 50
    • D. 80

Why: The Delaware Real Estate State Content Outlines published by Pearson VUE (publication #090802) state that the Delaware state examination consists of 40 scored items for the salesperson examination and 50 for the broker examination. The state portion also contains 10 unscored pretest items. The separate national/general portion is 80 scored items.

  6. 6. To pass the Delaware salesperson examination, a candidate must earn what score?

    • A. A raw score of 75 percent on the combined exam
    • B. A scaled score of 70 on each portion, general and Delaware law ✓
    • C. A scaled score of 75 on each portion
    • D. A raw score of 70 on the Delaware law portion only

Why: The Delaware Real Estate Candidate Handbook states that a passing score is 70 and that raw scores are converted into scaled scores ranging from 0 to 100. A candidate must pass both the general portion and the Delaware law portion. The scaled score is not a raw percentage, and numeric scores are reported only to failing candidates.

  7. 7. Under the Delaware Real Estate Commission rules, how many attempts does a salesperson applicant have to pass each portion of the examination before having to retake the pre-licensing course?

    • A. One
    • B. Two
    • C. Three ✓
    • D. There is no limit

Why: Section 2.1.2 of the Commission's Rules and Regulations (24 Delaware Administrative Code 2900) requires an applicant to pass both the general and State portions of the salesperson examination in no more than three attempts. An applicant who cannot pass within three attempts must retake the salesperson pre-licensing course.

  8. 8. How many hours of continuing education must a Delaware salesperson complete during a full two-year renewal period?

    • A. 14
    • B. 18
    • C. 21 ✓
    • D. 45

Why: Section 14.1.2 of the Commission's Rules and Regulations (adopted under the authority of 24 Delaware Code Section 2910(d)) requires each salesperson to complete 21 acceptable continuing education hours across seven named modules during the biennial renewal period. A first, shorter license period is prorated by the number of months the license was held.

  9. 9. Under Delaware law, a competitive market analysis (CMA) prepared by a licensee is:

    • A. an appraisal of market value
    • B. not an appraisal ✓
    • C. permitted only for a mortgage lender
    • D. prohibited for all licensees

Why: Section 2931 of Title 24 of the Delaware Code states that a competitive market analysis is not an appraisal. The CMA must carry a disclosure in at least 12-point bold type stating it is not an appraisal, and a licensee may not perform a CMA for the mortgagee on a property that is the subject of a signed agreement of sale.

  10. 10. In Delaware, a licensee working with a buyer or seller of a one-to-four family residence is presumed to be, unless hired as a common law agent by a written brokerage agreement:

    • A. a common law agent
    • B. a transaction broker
    • C. a statutory agent ✓
    • D. a subagent of the listing broker

Why: Section 2936(a) of Title 24 of the Delaware Code provides that unless specifically hired as a common law agent by a written brokerage agreement, a licensee is a statutory agent and not a common law agent. Section 2933 abrogates the common law of agency for licensees acting as statutory agents and describes the presumed buyer, seller, and dual agency relationships.

Frequently asked questions

Does Delaware split the real estate exam into a national part and a state part?
Yes. Delaware is one of the states that scores the two portions apart. The salesperson exam has a national/general portion of 80 scored items and a Delaware law portion of 40 scored items, and you must pass each portion with a scaled score of 70. If you fail one portion you may retake just that portion. The state law portion is unique to Delaware and covers the Commission's powers and duties, Delaware licensing requirements, disclosure and agency rules, the Landlord Tenant Code, condominium and common interest ownership law, transfer taxes, and other Delaware topics.
What score do you need to pass the Delaware real estate exam?
You need a scaled score of 70 on both the general portion and the Delaware law portion. Delaware uses scaled scores, not a raw percentage: raw scores are converted to a 0 to 100 scale and equated so that different exam forms are comparable. A scaled 70 is not the same as answering 70 percent correctly, and the numeric score is only given to candidates who fail.
How long is the Delaware real estate exam, and how many questions does it have?
You get four hours (240 minutes) to complete the whole exam in one sitting. The scored exam is 120 questions: 80 on the general portion and 40 on the Delaware law portion. Each portion also contains unscored pretest items (5 on the general portion and 10 on the state portion), which look like scored questions but do not affect your score. Answer every question, because you cannot tell the pretest items apart.
How much does the Delaware real estate exam and license cost, and how soon can you retake it?
The Pearson VUE exam fee is $88 per attempt, paid when you reserve; the test center does not take payment. After you pass, the Delaware salesperson license application fee is $149, plus a one-time $25 Real Estate Guaranty Fund fee, both paid through DELPROS. If you fail, you must wait 24 hours before rescheduling and you pay the $88 again. You may pass each portion in up to three attempts within one year of finishing the 99-hour course, or you must retake the course.
What education and other requirements does Delaware set before you can be licensed?
You must be at least 18, complete the 99-hour Delaware salesperson pre-licensing course, pass both portions of the Pearson VUE exam, and apply for the license within 12 months of finishing the course. You apply through DELPROS after passing, with the original score report, your course certificate, and a Statement of Broker of Record signed by your employing Delaware-licensed broker. New licensees (other than those licensed by reciprocity) must also complete 12 hours of new salesperson modules within 90 days of license issuance. Renewal is every two years, with 21 hours of continuing education due across the license term.
